Terms of Service

Please read these terms carefully before using our repair services. By using Cell+ services, you agree to be bound by these terms.

Welcome to Cell+ ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our repair services, website, and any related services provided by Cell+ located at 7251 S Cardinal Ave STE 600, Tucson, Arizona 85746.

By accessing our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

1. Acceptance of Terms

By bringing your device to Cell+ for repair, submitting a repair request online, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy.

You must be at least 18 years old or have parental/guardian consent to use our services. By using our services, you represent and warrant that you meet these requirements.

2. Services Provided

Cell+ provides repair and maintenance services for smartphones, tablets, game consoles, and related electronic devices. Our services include but are not limited to:

  • Screen and display replacements
  • Battery replacements and testing
  • Water damage repair and recovery
  • Charging port and component repairs
  • Software troubleshooting and updates
  • Diagnostic assessments

We reserve the right to refuse service to any device or customer at our sole discretion, particularly if the device appears to be stolen, if repairs pose safety concerns, or if we cannot obtain necessary parts.

3. Diagnostic Assessments & Estimates

We offer free diagnostic assessments to identify issues with your device. After diagnosis, we will provide an estimate for the repair cost. The estimate is valid for 30 days from the date of diagnosis.

Important: In rare cases, additional issues may be discovered during the repair process that were not apparent during the initial diagnostic. If this occurs, we will contact you for approval before proceeding with any additional work that would increase the cost beyond the original estimate.

If you decline the repair after receiving the estimate, there is no charge for the diagnostic service, provided you pick up your device within 10 business days. Devices not picked up within this timeframe may be subject to a storage fee of $5 per day.

4. Payment Terms

Payment is due in full upon completion of repairs and before the device is returned to you. We accept the following payment methods:

  • Cash
  • Credit and debit cards (Visa, MasterCard, American Express, Discover)
  • Digital payment methods (Apple Pay, Google Pay)

All prices quoted are in U.S. Dollars and include applicable taxes. Prices are subject to change without notice, but the price quoted at the time of your approval will be honored.

Abandoned Devices: If a device is not picked up within 30 days of completion of repairs and notification, and payment has not been made, we reserve the right to dispose of or sell the device to recover repair costs.

5. Warranty Coverage

All repairs performed by Cell+ are covered by a 90-day warranty on parts and labor from the date of repair completion. This warranty covers defects in workmanship and parts failure under normal use conditions.

What the Warranty Covers:

  • Defective replacement parts installed by Cell+
  • Workmanship errors made during the repair process
  • Issues directly related to the original repair

What the Warranty Does NOT Cover:

  • Physical damage caused after the repair (drops, impacts, liquid damage)
  • Damage caused by unauthorized repairs or modifications
  • Normal wear and tear
  • Issues unrelated to the original repair
  • Software issues, viruses, or data loss
  • Cosmetic damage or scratches not related to our repair

To make a warranty claim, you must present your original repair receipt. Warranty service is provided at no charge for covered issues. The warranty is non-transferable and applies only to the original customer.

6. Limitation of Liability

IMPORTANT - PLEASE READ CAREFULLY: To the maximum extent permitted by law, Cell+ and its employees, agents, and contractors shall not be liable for:

  • Data Loss: We are not responsible for any data, software, or information stored on your device. You are solely responsible for backing up your data before bringing your device to us for repair.
  • Pre-existing Damage: We are not liable for any pre-existing damage, defects, or issues not related to the repair we performed.
  • Consequential Damages: We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost business, or lost opportunities.
  • Device Value: Our maximum liability for any claim shall not exceed the amount you paid for the repair service. In no event shall we be liable for the full replacement value of the device.

Backup Your Data: We strongly recommend backing up all data, photos, contacts, and information before any repair. While we take precautions to protect your data, we cannot guarantee that data will be preserved during the repair process.

7. Customer Responsibilities

By using our services, you agree to the following responsibilities:

  • Data Backup: Back up all data on your device before bringing it in for repair.
  • Disable Security Features: Disable passcodes, Find My iPhone/Android Device Manager, and any other security features that may prevent us from testing your device after repair.
  • Accurate Information: Provide accurate contact information and a complete description of the issues with your device.
  • Ownership Verification: You represent and warrant that you are the legal owner of the device or have authorization from the owner to have it repaired.
  • Timely Pickup: Pick up your device within 10 business days of notification that the repair is complete or the estimate has been provided.

8. Device Inspection Upon Pickup

When you pick up your repaired device, you will have the opportunity to inspect it and test its functionality before leaving our premises. We encourage you to thoroughly test the device while you are at our location.

Acceptance of Repair: By taking possession of your device and leaving our premises, you acknowledge that you have inspected the device and accept the repair as complete and satisfactory. Any concerns or issues should be reported immediately before leaving.

If you discover an issue after leaving that is covered by our warranty, please contact us within 7 days to arrange for warranty service.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Cell+ or its content suppliers and is protected by United States and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written permission. The Cell+ name and logo are trademarks of Cell+ and may not be used without permission.

10. Third-Party Parts & Components

Unless otherwise specified, we use high-quality aftermarket parts that meet or exceed OEM (Original Equipment Manufacturer) specifications. While we strive to use the best available parts, some components may not be manufactured by the original device manufacturer.

Manufacturer Warranty: Please note that repairs performed by Cell+ using third-party parts may void any existing manufacturer warranty on your device. We recommend checking with the device manufacturer before proceeding with repairs if your device is still under warranty.

We do not guarantee compatibility with future software updates released by device manufacturers after repair. However, in most cases, devices continue to function normally with software updates.

11. Cancellation & Refund Policy

Before Repair Begins: You may cancel a repair request at any time before work begins at no charge. Simply contact us or visit our location to pick up your device.

After Repair Begins: Once repairs have commenced and parts have been ordered or installed, cancellations may not be eligible for a full refund. You may be responsible for the cost of parts that have been opened or installed.

Refunds for Warranty Issues: If a repair covered by our warranty fails, we will re-repair the device at no charge. If we are unable to successfully repair the device after a reasonable number of attempts, we will refund the cost of the original repair.

No Refunds for Completed Repairs: Once a repair is completed and you have accepted the device, refunds are not available except as outlined in our warranty policy.

12. Privacy & Data Protection

We respect your privacy and take reasonable measures to protect any personal information and data on your device. Our technicians will not access, copy, or share your personal data unless absolutely necessary for the repair process.

However, as stated in our Limitation of Liability, we are not responsible for data loss. We strongly recommend backing up all important data before repair.

13. Dispute Resolution & Governing Law

Informal Resolution: If you have any concerns or disputes regarding our services, we encourage you to contact us first to resolve the issue informally. Most issues can be resolved through direct communication.

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Jurisdiction: Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Pima County, Arizona, and you consent to the jurisdiction of such courts.

Arbitration: Any dispute that cannot be resolved informally may be subject to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Tucson, Arizona.

14. Severability & Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Cell+ regarding the use of our services and supersede any prior agreements or understandings.
